Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you and KissAsian (“we,” “us,” or “our”) governing your access to and use of https://kissasianweb.org and all related pages and features (together, the “Site”). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Site.

1. The Service

KissAsian is an online guide to dramas, films, and television programmes. The Site organises information about titles and displays video content through players embedded from independent third-party hosting platforms. We do not upload, store, or distribute video files, and we do not own the video content made available through embedded players.

2. Eligibility

You must be at least 13 years of age, or the minimum age required in your jurisdiction if that is higher, to use the Site. By using the Site, you represent that you meet this requirement, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Site under any applicable law.

3. Licence to Use the Site

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use the Site for your own non-commercial entertainment. All rights not expressly granted to you in these Terms are reserved.

4. Acceptable Use

You agree not to:

  • interfere with or disrupt the operation of the Site, or impose an unreasonable load on its infrastructure;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • use the Site for any commercial purpose without our prior written consent.

5. Submissions and Comments

The Site allows visitors to post comments. You are solely responsible for any comment you submit. By submitting a comment, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute it in connection with the Site. You represent that your comment is lawful, that you hold all rights necessary to submit it, and that it does not infringe the rights of any third party. Comments must not be defamatory, obscene, hateful, harassing, or misleading, must not contain spam or unsolicited promotion, and must not link to infringing material. We may review, edit, refuse, or remove any comment at our discretion and without notice.

If you send us feedback, suggestions, or content requests, you agree that we may use them without restriction and without any obligation to you.

6. Third-Party Content, Embedded Players and Links

Video content on the Site is provided by third-party hosting platforms through embedded players. When you play a video, you interact directly with the host, and your use of its player is subject to the host’s own terms and policies. We do not control, verify, or endorse third-party content and make no representation as to its accuracy, legality, quality, or availability. Such content may be removed, altered, or become unavailable at any time without notice.

Hosts may display their own advertisements within their players. Those advertisements are not placed by KissAsian; we do not endorse them and are not responsible for them or for any dealings you have with their advertisers. Exercise caution with pop-up windows, and do not download or install software at the request of a video player.

The Site may contain links to third-party websites. Such links are provided for convenience only. We are not responsible for the content, policies, or practices of linked websites, and you access them at your own risk.

7. Intellectual Property

The Site, including its design, layout, software, text, graphics, and the selection and arrangement of its information, is owned by or licensed to KissAsian and is protected by copyright, trademark, and other intellectual property laws. Posters, titles, and other materials relating to individual works remain the property of their respective owners and are used for identification and informational purposes. Nothing in these Terms transfers any ownership right to you.

8. Copyright Complaints

We respect the intellectual property rights of others. If you believe that material available through the Site infringes your copyright, please send a notice in accordance with our Copyright Policy to support@kissasianweb.org. We respond to valid notices in accordance with applicable law, which may include removing or disabling access to the material concerned.

9. Privacy

Our collection and use of personal information in connection with the Site is described in our Privacy Policy, which forms part of these Terms.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE AVAILABLE, ACCURATE, OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KissAsian AND ITS OPERATORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY THIRD-PARTY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, IT IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless KissAsian and its operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Site, any comment you submit, or your violation of the rights of any third party.

13. Suspension and Termination

We may suspend or terminate your access to all or any part of the Site at any time, with or without notice, for any reason, including a breach of these Terms. On termination, the licence granted to you ends immediately. Provisions of these Terms which by their nature should survive termination shall survive, including those concerning intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

14. Changes to the Site and to These Terms

We may modify, suspend, or discontinue the Site or any part of it at any time without liability to you. We may also revise these Terms from time to time. Revised Terms will be posted on this page with an updated “Last Updated” date and take effect when posted. Your continued use of the Site after revised Terms take effect constitutes your acceptance of them.

15. Governing Law and Disputes

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of United States, without regard to conflict-of-law principles, and are subject to the exclusive jurisdiction of the competent courts of United States. Before commencing any proceedings, you agree to contact us at support@kissasianweb.org and to attempt in good faith to resolve the dispute informally for at least thirty (30) days. Nothing in this section deprives you of the protection of mandatory consumer laws of your country of residence.

16. General Provisions

  • Entire agreement. These Terms, together with our Privacy Policy and Copyright Policy, constitute the entire agreement between you and us regarding the Site.
  • Severability. If any provision of these Terms is held invalid or unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms. We may assign them without restriction.
  • Force majeure. We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control.
  • Headings. Section headings are for convenience only and have no legal effect.
